Limitation Of Liability

In no event shall Pharma Nord Sdn Bhd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

your access to or use of or inability to access or use the Service;
any conduct or content of any third party on the Service;

Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Marketing Communications

We provide marketing communications that promote the use of or offer participation in Pharma Nord products, services, programs, research events or provide other information that may be of interest to you, such as information on certain health conditions.  We will use your Personal Data to send you marketing communications and to determine the types of marketing communications to send. You can opt-out of marketing communications at any time. Marketing communication opt-out instructions are included in each marketing communication you receive, or you can email us at marketing@pharmanord.com.my

Compliance with Laws and Regulations

We may process your Personal Data to comply with laws and regulations, including those related to pharmacovigilance. We may also use Personal Data to monitor compliance with our policies and procedures, for fraud prevention, and to investigate and prosecute users who violate our rules or who engage in behaviour that is illegal or harmful to others or to others’ property.

Additional Information for Health Care Professionals

We may collect additional categories of Personal Data if you are a health care professional, as described in this section. We also use and disclose Personal Data about health care professionals for the additional purposes described in this section. The categories of Personal Data collected and the purposes of use and disclosure described in this section are in addition any other collection, use and disclosure of Personal Data practices described separately in this Privacy Notice.

Additional Personal Data that PNSB May Collect about Health Care Professionals

If you are health care professional, we may collect Personal Data about you directly from you, or from third-party sources such as the organization where you work, publicly available sources, interactions with Pharma Nord Sdn Bhd (including online available sources), and participation in Pharma Nord Sdn Bhd-sponsored or -supported initiatives such as Pharma Nord Sdn Bhd-sponsored clinical research and development activities, third-party databases, and reporters of pharmacovigilance events.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.  

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
